Before you have entered
into any agreement to buy a property, we will provide tax
advice to make sure you are fully aware of the respective Bulgarian legislation.
Whether you plan to live in Bulgaria in the future or you want to rent your new
property, whether you prefer to sell it one day or pass it to your children, we
can discuss with you all tax considerations. You will get a full consultation
on the taxes applicable to your situation and the options available to you.
Foreigners
are currently not allowed to own land in Bulgaria. This restriction in the Bulgarian
legislation, which has kept prices low, is expected to be eased with accession
to the EU. If you want to buy land in Bulgaria before things have changed you
will have to form a Bulgarian company, which can
hold the land and any buildings. We will take care of the registration formalities.
Bulgarian law requires a minimum capital to be paid in before registration and
we can arrange financing for you to meet this requirement. We also offer company
management services for as long as the company exists.
The conveyancing
process is more straightforward if you are only buying a flat. There is no restriction
on personal ownership for foreigners. Our lawyers will check the title and do
all necessary searches before preparing a written contract for you to sign. Like
in the UK, you will be expected to pay deposit at this point. The lawyer will
also be responsible for managing all payments in relation to the purchase. The
transaction is completed by both parties signing a deed before a Notary who then
submits it for registration at the Land Registry office. The lawyer can act as
your attorney and sign the deed on your behalf, if you so wish. The payment of
the purchase price is usually made on the same day, together with the payment
of the notary and municipal fees due for the transaction. Then you can take possession
of your new property.
Having acquired real estate abroad, there are some
estate planning considerations you may wish to discuss
with our lawyers. A will prepared by a solicitor in the UK will not be valid under
Bulgarian law. We can assist you in making a will relating to your Bulgarian property,
which complies with the requirements of the applicable Bulgarian legislation.

Most
of the properties offered for sale, unless they are recently built ones, are in
need of some renovation. The developers are more
often than not selling new construction in an unfinished state (e.g. without flooring,
tiles and wall paper). We can find for you reliable designers and contractors
to carry out the work necessary to finish or update the property you have bought.
Exactly like you would do in the UK, you would want to have home insurance
for your new Bulgarian property as soon as possible. We can find the best deals
for you and arrange the payments.
We offer property
management services as well. These include cleaning and maintenance, payment
of bills for water, electricity, etc. We can arrange the property to be rented,
supervise its use and collect the rent for you.
There are certain taxes
due by each property owner in Bulgaria. We can make the annual tax
payments for you. We also offer legal representation before local authorities,
public bodies or any other persons, whenever you may need it.
If you have
formed a company with the purpose of holding the real estate assets, we will take
care of the company management. Through appointed
professionals we provide all services guaranteeing that the company is always
compliant. We prepare and submit regularly the required documents to the Company
Registry, the tax office and other authorities.
